Proceeds of the auction, will go towards the recently established PACC Portage High School Scholarships.

The auction became competitive, especially when a Green Bay Packers helmet, Winters, came up for bid. It sold for $1,000, more than any other of the donated items. Other high-bid items were a big screen television, an outdoor grill, Amtrak trip for two, a Lazy Boy and various computer equipment and services. One of the members of the PACC Scholarship Committee, who asked not to be identified, was extremely pleased with the outcome of the auction. He said the chamber had pledged four $500 scholarships to be awarded to graduates of either Portage High School or the charter school, and who will attend either a two- or four-year college.

Thirty-three students have applied and are now under review by the three-person committee. The committee member said the chamber decided late last fall to invest some money in the future of some of Portage's children, and the best way they determined was through scholarships. Patrolman Eric Jorgensen, 29, of rural Baraboo, was charged with three counts of misdemeanor sexual intercourse with a child 16 or older in a complaint filed by special prosecutor Donald V.

Latorraca, an assistant attorney general based in Madison. The complaint follows an eight-month investigation by Special Agent Amy Blackwood of the state Division of Criminal Investigations. Jorgensen has been with Nicole Henderson and Mike Audiss, of Portage, had a daughter, Carlie Marie, on Feb. 21. Carlie weighed 7 pounds, 7 ounces and measured 19 inches.

Based on testimony from two unnamed juvenile females, Blackwood reports Jorgensen suggested during conversations on different occasions that he, the 16- year-old and one or the other of the juveniles participate in a "threesome." A fellow Baraboo police officer told Blackwood that Jorgensen made repeated sexual comments about the 16 year old. On one occasion, he saw her on the street and said using "rather crude language," that he wanted to have sex with her, the complaint states.

If Jorgensen is convicted of one or more of the misdemeanor charges, each count carries a maximum penalty of nine months in county jail and a $10,000 fine. It is not clear whether or not James himself had been drinking at the party, although the coroner's report found no traces of alcohol in James' system. The original criminal complaint, which is based on Williams' statements to police, was filed by the state in May 2000. The court dismissed the first complaint which charged the three men with reckless homicide, but Dufour refiled an amended complaint in October 2000.

During the hearing Monday, defense attorney Alan J. White tried to prove that Detective Thomas Schrank, the officer who took Williams' statement on Feb. 11, 2000 regarding James' 1999 death, did promise Williams immunity if he gave "truthful" information regarding the events leading up to James' death. Dufour argued that Schrank did show Williams an immunity agreement, but Williams did not accept the offer. Wright rejected Dufour's argument, and instead, he told the court that regardless of testimony given by both Williams and Schrank on Monday, both of their statements could be taken to be "self-serving." 'He said the only way Dufour could prove that Williams denied the offer would be to produce a taped rejection, which Dufour did not have.

Attorney Christopher T. Van Wagner, lawyer for defendant Shane Northam, also requested the court consider a "Frank's-Mann" motion. The motion, Van Wagner said, focuses on two concerns regarding the amended criminal complaint. First, Van Wagner said, the amended complaint states the young men all "gave" each other the pills in the bottle. Van Wagner said this is a very different statement from the one used in the first complaint which suggests the young men all "used" the drugs.

Second, Van Wagner said, he plans to argue that between the time of the first complaint's dismissal and the filing of the second complaint, Dufour has added comments that appear to be fabricated or embellished in order to continue trying the case.
