Stephen Hurley consults with Portage Detective Capt Ken Manthey as the trial of a Baraboo police officer charged with having sexual intercourse with an underage girl continued Thursday Manthey conducted an investigation of the alleged incidents as part of a personnel investigation by the police department Hurley used the Portage officer's report in an effort to point out apparent former policeman Eric Jorgensen and described his alleged victim as untruthful as his trial on charges of having sex with an underage girl had its last day of testimony Madison-based defense attorney Stephen Hurley was calling the shots Thursday as the 30-year-old rural Baraboo trial headed into its third day in Sauk County Circuit Court The former Baraboo police officer faces three misdemeanor charges of sexual intercourse with a child who is 16 or older The charges are based on allegations by a Baraboo teen who was 16 during the alleged incidents She told police Jorgensen had a total of six sexual contacts with her from late in 1999 through February of 2000 The first of three counts for which she can specify a date occurred during a police ride-along experience in November of 1999 These three incidents are the basis of the criminal charges against Jorgensen Several witnesses Thursday described the teen now 18 as somebody with a reputation for not telling the truth They also attacked Baraboo police officer Jennifer Langfeldt-Rupert During the second day of trial she described several sexually explicit comments she said Jorgensen made about the girl Patrol Officer Lawrence Luebtke a 32-year Baraboo veteran said he occasionally socialized with Jorgensen He said the defendant was a highly capable officer like to have backing him up like to have him there he said Luebtke said he doubted credibility will use people to get he stated1 Kay Howyer a 10-year Baraboo officer who now works for the Wild Rose Police Department said she was training officer and a friend He was very talented in communicating with young people in finding peo- The alleged victim said sexual activity with Jorgensen occurred on Dec 2 at his home on Potter Road Illicit sexual acts also allegedly occurred on one or the other day in April when the girl said she met Jorgensen inside the former Baraboo dog pound on Hill Street Elizabeth Jorgensen laid out a schedule of activities the couple were involved in on each of the days buying a new vehicle sharing a takeout meal and purchasing a roto-tiller at the Farm and -Fleet store in town By her tally of the activities and travel times involved there was no opportunity for the illicit sexual activity However Latorraca questioned her and other witnesses testifying about their activ- -ities on those days They all admitted that the had not actually looked at the clock to note the time the activities on those days actually took place Following the last testimony of the day Hurley said his defense case was finished Judge James Evenson then asked Jorgensen whether he wanted to testify or not The judge advised him that he was not required to testify on his own behalf but had the right to do so The defendant answered briefly that he had decided he was not going to testify in the case The seven-woman six-man jury is scheduled to meet at 8:30 am today As part of the routine procedure one of the 13 jury panel members will be randomly selected as the alternate and will be released before deliberations begin The judge will read them some final instructions after which the defense and prosecution will give their closing arguments Evenson said the jury-would begin deliberating the case by late morning or early afternoon Jorgensen is free on a signa- ture bond If he is convicted of one or more of the charges he faces up to two years three months jail time and $30000 in fines with the alleged victim However she testified that the reputation is that always verv truthful" Asked if she ever talked to children about sexual matters Browning said sometimes it is appropriate when investigating possible sexual assault or some problem in the home However she said casual conversation on sexual issues' with a child is something a good officer dot's not do Baraboo High School graduate Chris Alexander 18 said he used to hang around with a group of youths that the alleged victim also shared activities with They would go out for activities such as how 1- ing she was untruthful about things that happened in school" he said A major witness was the defendant's wife Elizabeth Jorgensen principal -at Fairfield Elementary School During the period of alleged 'sexriiil contacts with the teen the two were engaged to be married and living together Under questioning from Hurley Elizabeth described her and her people and to whom people are willing to talk Under probing from Latorraca she said Jorgensen sometimes made sexual comments but nothing that made her uncomfortable According to a report produced bv an investigator working for the defense Browning said makes the same comments most of the guys on the force do But nothing demeaning or do not take offense at anything Eric ever said" Browning told Latorraca Browning admitted that she had no personal contact World Trade Center and the Pentagon He apologized the next day and said would donate the profits from the dramatic increase to the American Red Cross Gov Scott McCallum directed state investigators to look into increases at the pump after the teirorist attacks The state sent information from its investigation to district attorneys in Barron Dane Marinette Outagamie Rock and Winnebago counties for possible charges It initially listed Manitowoc as one of the counties But McCallum spokeswoman Debbie Monterrey-M i llett said the state was still investigating possible charges there and could send information on its probe to Manitowoc at a later date Marinette County District Attorney Joseph Klumb said he received information on one
